Premise
The ELMA Di E. Benabbi company cares deeply about the privacy needs of its Users and on this page intends to describe in a transparent and detailed way the ways in which it processes their personal data; this is so that all Users can provide free and informed consent to the processing of data, in full awareness of the guarantees provided by law and of ELMA Di E. Benabbi’s constant commitment to protecting their privacy.
This information is also provided in compliance with the art. 13 of Legislative Decree 30 June 2003, n. 196 and relates to all the services offered by ELMA Di E. Benabbi through its web pages.
Privacy Policy
The information is also inspired by Recommendation no. 2/2001 that the European authorities for the protection of personal data, gathered in the Group established by art. 29 of directive no. 95/46/EC, adopted on 17 May 2001 to identify some minimum requirements for the collection of personal data online.
However, this information does not refer to sites that are not owned by ELMA Di E. Benabbi and which may be accessed via links on our sites. ELMA Di E. Benabbi has no power of control over them and therefore declines any responsibility regarding the processing of Users’ personal data carried out through such sites.
This information may undergo changes aimed at updating it with respect to legislation and any technological developments that may occur.
Owner and responsible for data processing
Consultation of this site may involve the processing of some of the User’s personal data. By “processing” of personal data we mean “any operation or set of operations, carried out with or without the aid of electronic or automated means, concerning the collection, recording, organisation, conservation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, cancellation and destruction of data”.
The “owner” of the processing of such data is ELMA Di E. Benabbi – La Spezia, Viale G. Amendola 24, Italy – Operational headquarters: Porto Mirabello (SP).
As provided in the information referred to in article 13, paragraph 1 – letter f of Legislative Decree 30 June 2003, n. 196 “When the owner has designated multiple managers, at least one of them is indicated, indicating the site of the communication network or the methods through which the updated list of managers can be easily found”. Types of data processed and purposes of processing
Browsing data
The computer systems and software procedures used to operate the sites owned by ELMA Di E. Benabbi automatically acquire, during their normal operation, some personal data relating to the User’s browsing.
This is information that is collected exclusively for the purpose of obtaining anonymous statistical information on the use of the site and to check its correct functioning, and which is used only within the company; such information could however, by its very nature, allow us to trace the identity of the User, also through processing and association with data held by third parties.
This category of data includes:
the IP addresses of the computers used by the Users who use the service; the number of accesses; the pages viewed; the date and time the access occurred; the URL where your browser was before viewing our page; the navigation browser; the operating system used.
Such data will in no case be used to carry out so-called “profiling” activities of the User nor will they be disseminated or communicated to any person external to the company; they will in any case be canceled after 30 days from their registration.
Data provided voluntarily by the User
The data optionally and freely provided by the User by completing the form will be acquired together with their email address. Such data may possibly be used by ELMA Di E. Benabbi only to improve and make the service provided more effective. However, these data will not be disseminated or communicated externally.
Methods of processing and scope of dissemination of data
The personal data, held for the purposes set out above, are processed correctly, lawfully and transparently, through the use of automated tools.
Optional provision of data
Apart from what is specified above in relation to navigation data, the personal data that must be provided by Users are marked with an asterisk placed in the margin of the fields in the forms. These mandatory data normally consist of the name and surname of the requesting party, the organization or company to which they belong, a telephone contact number and the e-mail address. The provision of any other personal data requested in the forms for accessing the service is therefore optional and entirely left to the will of the User in this sense.
Failure to provide personal data by the User does not entail any prejudicial consequences for him other than, in the case of failure to provide the mandatory data, the failure to provide the requested services.
Informed consent
Without prejudice to what is specified above in relation to navigation data, all the forms on this site, within which personal data is requested, are provided with a specific disclaimer which refers to this document. The transmission of the form is subject to having read and accepted this document.
What ELMA Di E. Benabbi intends to guarantee is that Users give consent to the processing of their personal data only after having acquired awareness of all the rights guaranteed to them by law and of the policy followed by the company in the processing of such data.
Rights of interested parties
Pursuant to art. 7 of Legislative Decree 30 June 2003, n. 196, the interested party has the right to obtain the indication:
- of the origin of the personal data;
- of the purposes and methods of processing;
- of the logic applied in case of processing carried out with the aid of electronic instruments;
- of the identification details of the owner, the managers and the representative designated pursuant to article 5, paragraph 2;
- of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as designated representatives in the territory of the State, managers or agents.
The interested party also has the right to obtain:
- l’aggiornamento, la rettificazione ovvero, quando vi ha interesse, l’integrazione dei dati;
- la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati;
- l’attestazione che le operazioni di cui ai numeri 1 e 2 sono state portate a conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto tutelato.
Finally, the interested party has the right to object, in whole or in part:
- for legitimate reasons to process personal data concerning him, even if pertinent to the purpose of the collection;
- to the processing of personal data concerning him for the purposes of sending advertising material or direct sales or for carrying out market research or commercial communication;
The above-mentioned rights can be exercised at any time by forwarding a simple request by registered letter, fax or e-mail to the data controller. The manager will contact the applicant as soon as possible.

For any information, request or clarification relating to the privacy of Users, as well as for the exercise of the rights referred to in the previous paragraph, it is possible to contact the data controller at the company headquarters.
Cookie & Privacy
In compliance with the provisions pursuant to and for the purposes of the art. 13 Legislative Decree 30 June 2003, ELMA By E. Benabbi – La Spezia, Viale G. Amendola 24, Italy – Operational headquarters: Porto Mirabello (SP), as data controller, informs applicants of information relating to the services referred to in the company activity, on what are the purposes and methods of processing the personal data collected, their scope of communication and dissemination, as well as the nature of their provision.
The data collected from those interested in receiving information constitute data subject to processing and are processed and used directly to fulfill purposes instrumental to the request sent by the interested parties themselves, and the consequent fulfillment of the same.
The data processing is carried out through paper, IT and telematic media by specially appointed internal subjects.
The data are kept only for the time strictly necessary to interact for the release of information or to give feedback and updates to applicants regarding the services offered and guaranteed by the company, and in any case no later than two years from the registration of the data and without prejudice to further obligations of conservation deriving from the possible establishment of a contractual relationship with the interested party.
The personal data collected in this way will not be disclosed, sold or exchanged with third parties, except for communications necessary to carry out the activities referred to in the aforementioned purposes.
The interested party will be able to assert their rights as expressed in the articles. 7, 8, 9 and 10 of Legislative Decree 30 June 2003 n. 196, by contacting the data controller. In particular, according to art. 7 the interested party will be able to obtain confirmation of the existence or otherwise of personal data concerning him, even if not yet registered, and their communication in an intelligible form. The interested party has the right to obtain indication of: a) the origin of the personal data; b) of the purposes and methods of the processing; c) of the logic applied in case of processing carried out with the aid of electronic instruments; d) of the identification details of the owner, managers and the designated representative pursuant to article 5, paragraph 2 ; e) of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representatives in the territory of the State, managers or agents. The interested party has the right to obtain: a) updating, rectification or, when interested, integration of the data; b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed; c) certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case in which this requirement is proves impossible or involves a manifestly disproportionate use of means compared to the protected right. The interested party has the right to object, in whole or in part: a) for legitimate reasons to the processing of personal data concerning him, even if pertinent to the purpose of the collection; b) to the processing of personal data concerning him for the purposes of sending advertising or direct sales material or for carrying out market research or commercial communication.
The provision of data is optional but necessary, as any refusal to respond will make it impossible for the owner to process the requests of the interested parties.
Pursuant to Legislative Decree 196/2003, consent to the processing of the aforementioned data is necessary as they are collected outside of previous contractual agreements.
